Terms of Service

These terms govern your use of the hosted OpenUptime service at openuptime.app, operated by the OpenUptime contributors. By creating an account or using the service you agree to them. If you do not agree, do not use the service.

The service and the source code

OpenUptime's source code is released under the MIT License, and you may self-host it under that license. These terms apply only to the hosted service at openuptime.app, not to your use of the source code. The MIT License governs the code; these terms govern the hosted service.

Your account

You are responsible for your account, for keeping your password and API keys secret, and for everything done through them. Provide accurate information and tell us promptly if you suspect unauthorised access. You must be at least 16 years old.

Acceptable use

  • Only probe what you are authorised to probe. Monitors must target systems you own or have explicit permission to test.
  • Do not use monitors, heartbeat endpoints or alert channels to attack, scan, overload or harass third parties, or to run denial-of-service traffic, including by setting very short intervals against systems that are not yours.
  • Do not use the service to send spam or unsolicited messages through alert channels or status page subscriptions, or to host unlawful, infringing or deceptive content on status pages.
  • Do not try to break, probe or circumvent the service's security, rate limits or other users' data, and do not overload the API.
  • Do not use the service to reach private or internal addresses you are not permitted to access.

You are responsible for the content of your status pages and the messages you send to subscribers.

Availability and no warranty

We run the service on a best-effort basis. It is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation, that checks will run on time, or that alerts will be delivered. Do not rely on OpenUptime as the only means of detecting failures in safety-critical systems.

Suspension and termination

You can stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms, put the service or others at risk, or are abandoned, and where practical we will tell you why. After termination your data is deleted as described in the Privacy Policy.

Limitation of liability

To the extent permitted by law, the OpenUptime contributors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from your use of the service, including missed or delayed alerts and outages that go undetected. Our total liability for any claim is limited to the greater of the amount you paid us in the previous twelve months and USD 50. Nothing here excludes liability that cannot be excluded by law.

Your content

You keep ownership of the data and content you put into the service. You grant us the limited right to store, process and display it as needed to operate the service for you, including publishing your status pages as you configure them.

Changes

We may update these terms and the service. If a change is material we will update the date below and, where practical, notify you by email. Continuing to use the service after a change means you accept the new terms.

可接受的使用方式

  • 只探测你有权探测的对象。监控项只能指向你自己拥有或已获得明确许可测试的系统。
  • 不得利用监控项、心跳端点或告警渠道攻击、扫描、压垮或骚扰第三方，或发起拒绝服务流量，包括对不属于你的系统设置极短的检测间隔。
  • 不得通过告警渠道或状态页订阅发送垃圾信息或未经请求的消息，也不得在状态页上发布违法、侵权或欺骗性内容。
  • 不得试图破坏、探测或绕过服务的安全措施、限流或其他用户的数据，不得过度请求 API。
  • 不得利用本服务访问你无权访问的私有或内部地址。

你需对状态页的内容以及发送给订阅者的消息负责。

可用性与免责

我们尽力提供服务，但不作保证。服务按“现状”和“可用”状态提供，不附带任何明示或暗示的担保，包括适销性、特定用途适用性和不侵权。我们不保证服务不中断或无错误，不保证检测按时执行，也不保证告警一定送达。请勿将 OpenUptime 作为安全关键系统唯一的故障发现手段。

暂停与终止

你可以随时停止使用并删除账户。如账户违反本条款、危及服务或他人，或长期废弃，我们可能暂停或终止该账户，并在可行时说明原因。账户终止后，你的数据将按隐私政策所述方式删除。

责任限制

在法律允许的范围内，OpenUptime 贡献者不对因使用本服务产生的间接、附带、特殊、后果性或惩罚性损害，或利润、收入、数据、业务的损失负责，包括告警遗漏或延迟及未被发现的故障。对任何索赔，我们的总责任以你过去十二个月已支付金额与 50 美元中的较高者为限。本条款不排除依法不能排除的责任。

你的内容

你保留对自己录入的数据和内容的所有权，并授予我们为向你提供服务所必需的有限权利，以存储、处理和展示这些内容，包括按你的配置发布状态页。

条款变更

我们可能更新本条款和服务。如有重大变更，我们会更新下方日期，并在可行时通过邮件通知你。变更后继续使用服务即视为接受新条款。
